E-discovery Presents Challenges
With the Federal Rules for Civil Procedure (FRCP) now more than a year old, the consensus seems to be that organizations are struggling to understandd and adopt strategies to meet the new e-discovery regulation. According to eWeek, two-thirds of U.S. businesses are unprepared to meet e-discovery requirements. Not only have recent court cases called for businesses to produce necessary information, they have also wanted companies to have defined retention policies, making records management a key strategy in the event of litigation. In addition, eWeek found that 66 percent of companies do not have the e-mail archiving technology to comply with e-discovery, either. Without the right policies and technology in place, companies will have to search multiple sources for information and risk the possibility that the information won't be found at all.
